Terms of Service

1. The service

KomplyZA provides security and compliance readiness tools for South African organisations, including assessments, policy generation, risk tracking, and related features as described in the product.

2. Free tier limitations

Free tier usage is subject to quotas and feature limits published in the product (for example: assessments, remediation items, tabletop exercises, and PDF exports per module). Quotas may reset on an anniversary basis from your signup date. We may adjust free tier limits with reasonable notice.

3. Paid subscriptions

Paid plans are billed in ZAR via our payment provider. Fees, renewal, and cancellation terms are presented at purchase. Failure to pay may result in suspension of paid features.

4. Acceptable use

You agree not to:

• Violate applicable law, including POPIA and the Cybercrimes Act;
• Attempt to gain unauthorised access to the service, other accounts, or our systems;
• Use the service to distribute malware, spam, or abusive content;
• Reverse engineer or scrape the service except as permitted by law;
• Misrepresent compliance status or misuse outputs (for example generated policies) as legal advice.

KomplyZA provides operational readiness tools; it is not a substitute for legal counsel or regulated audit.

5. Your data and ownership

You retain ownership of the content and organisational data you submit. You grant us a licence to host, process, and display that data solely to provide and improve the service, in line with our Privacy Policy.

6. Confidentiality and security

We implement reasonable technical and organisational measures to protect your information. See our Security & trust overview for high-level practices.

7. Liability

To the fullest extent permitted by South African law, KomplyZA is not liable for indirect, consequential, or punitive damages, or for loss of profits, revenue, or data. Our aggregate liability arising from these terms or the service is limited to the fees you paid us in the twelve (12) months before the claim (or, for free users, to R0), except where liability cannot be limited by law.

8. Changes

We may update these terms. Material changes will be communicated in-product or by email where appropriate. Continued use after changes constitutes acceptance.

9. Governing law and jurisdiction

These terms are governed by the laws of the Republic of South Africa. You submit to the exclusive jurisdiction of the South African courts, subject to mandatory consumer protections that cannot be waived.
